Can I use images of someone I interviewed if I forgot to ask their explicit permission to use pictures of them in my news item (on TV)?

A person who allows an interview with a TV journalist, is immediately assumed to have given permission for publication of their image. The same is valid for a person giving a press conference. Yet in other cases, it is valid that journalist must first ask permission to publish images of a private person. That is certainly the case when the content is used for a commercial goal.
